The examiner confirmed that they had issued an intrusion order into the computer of the defendant's car and when asked whether they had managed to penetrate
To the computer he testified:
"No, because what I'm relying on is a tester named Tal Bracha who ordered a special cable.
(Court's Note The witness Maayan in the memorandum of the examiner Tal Bracha), Bracha is the examiner who is responsible, among other things, for the subject of the CDR, he writes in the memorandum that he ordered the cable that is compatible with the computer according to the car manufacturer to the specific computer of the defendant's vehicle and he notes that the cable has arrived and at the time of the examination this cable is not compatible with the computer.
He checked the rest of the cables that the Israel Police has, but without matching.
From what I know about these cablesEach manufacturer has its own special cable and sometimes each model has its own special cable, we waited about 4 months for this cable to arrive from abroad and after we saw that there was no compatibility and he said he couldn't unload, it was actually the last action in the case and the case was transferred to the State Attorney's Office." (See his testimony of January 15,2025, p. 54, paras. 22-30).
The examiner confirmed, that there is no memorandum in the investigation file of the person who dismantled the computer of the defendant's car, and in relation to the vehicle involved, he testified:
"Q. So we also don't have data in the file that says that Kia doesn't have a computer that can be seized or hacked?
A. In the case there is no reference to the Kia airbag computer, as I told the court before, a review of the list of vehicles that support CDR, the 2013 Kia Picanto car does not support this software.
Q. No support or no computer, I'm trying to understand?
A. From what I know there is an airbag computer, the fact that airbags were opened in the Kia car, it is simply impossible to extract the data." (See his testimony of January 15,2025, p. 55, paras. 6-11).
