The examiner testified, because the goal is that the field of vision experiment will be under the conditions in which the accident occurred.
When he was told that the experiment was done about 4 months after the accident and in the summer and not on a wet road, he replied, because
He decided to do the experiment after taking testimony from the witness Elon Zadok.
The examiner was asked whether there is any significance when the road is wet to experiment with the field of vision with lights because there is light reflectionHe testified:
"A. Not because I did not check from what distance it is possible to see and if the light is reflecting, but I checked whether it is possible to distinguish the position of the lanes in relation to the lights, if he sees lights, whether he can distinguish which lane it is, and whether the rear of the vehicle involved can be seen properly.
...
A. Even if it is high lights for the defense method, the lights of the traveling vehicle have almost no meaning. Even if I had done the experiment when I turned off my lights completely, the result would have been the same because I look ahead and my lights are irrelevant to the accident. In the experiment, I am the witness.
Regarding the cloudiness and rainEven if there are clouds, it should not raise or lower too much, the shape of the vehicle that arrives does not appear to be because it was dark, lights we will see both in the clouds and in the rain, and according to the testimonies there was no rain at the time of the accident, there was a wet road." (See his testimony of January 15,2025, pp. 67-68, paras. 28-30,5-10).
The examiner testified, because in the field of vision test conducted by the vehicle that simulated the defendant's vehicle, it did not have high lights, but with white light, and it was not dazzling, as he said:
"Q. Do you have documentation of what lights you used in the experiment? Everyone told you that they drove in normal lights, because it seemed to me in a high-light experiment.
A. The range of high light is 100 meters, the normal light range is 30 meters, you can see that the beam of the vehicle in the experiment is really short, you can see that there is a section of shadow coming from the vehicle that simulates the defendant's vehicle, and when he advances in the experiment you can see that it illuminates the part of the shadow and therefore it is ordinary lights." (See his testimony of January 15,2025, p. 68, paras. 17-21).
