The defendant repeatedly testified about the occurrence of the accident when suddenly a car came in front of him, see lights, collision and boom.
When asked if this is the case, does he have an explanation as to how the vehicle involved entered his lane, he referred again to the testimony of the witness Ayalon Zadok, who said that the Kia was in a swerve.
Subsequently, he was asked about his interrogation by the police on this matter and testified:
Q. But in your interrogation on line 61, you are asked if you saw the vehicle involved... "I saw her in front of me, it's hard for me to tell if she was in a sharp deviation...", later in the interrogation in the video at 26:24, you say that the line of travel of the vehicle involved was exiting out of its lane into my lane and you even demonstrate it to the investigator and then the investigator asks for diagonal traffic and you answer "probably yes" so I ask you, here you say in court that you see boom lights and collision and in the interrogation you say that you probably see diagonal traffic or leakage.?
A. That's probably the key word in this whole answer.
To Beyham's question"Q, how did you testify in court that you saw lights, boom lights and a collision and you didn't say the word 'probably, ' and in the interrogation you said, 'Apparently where did it come from?
The witness replies: Because it's factual. These are the facts of the case. When Maayan asks me the following question, I say "probably" and everything you added that I added before the word "probably" in order to explain how we came to this fact that the vehicle is in front of me. I don't know how to answer beyond that." (See his testimony of April 1,2025, pp. 107-108, paras. 32-33,1-11).
The defendant was confronted with his version in the police interrogation, that he assumed that the woman involved had entered his lane because she had overtaken and he was told that his hypothesis was incorrect, according to the witnesses who testified here, that she overtook but returned to her lane, continued to drive in her lane for some time before the collision, and he testified:
"The other victim in the vehicle involved was standing here until Itai Maimon, and when questions about the overtaking, it appears that he did not know how to say unequivocally that the Kia vehicle returned to the lane in his driving lane. Beyond the fact that Ayalon Zadok testified that he was overtaken by the Kia, he himself as a driver was overtaken by the Kia car, and beyond that he sees the vehicle involved in a swerve, if it came to overtake another vehicle, I don't know." (See his testimony of April 1,2025, p. 108, paras. 23-26).
