Not only that., the defense's attempts to raise a possible theory as to how the accident occurred in the route of travel involved and her fault, do not correspond to the scene of the accident and were not even raised at the first opportunity in the defendant's interrogation by the police, as a possible version of the accident.
Did the defendant deviate from his lane 3 times:
Section 6 of the amended indictment is worded as follows:
"At a certain point in the journey, when the defendant approached Kilometer 8.1 on the road, he swerved with his vehicle into the opposite lane in the direction of his travel, returned to his original lane, then swerved again into the opposite lane, returned to his original lane again, all while Vehicle B was driving in front of him in the opposite lane, while reducing the distance between them. When the defendant reached Kilometer 8.1 on the road, he swerved with his vehicle on the third into the opposite lane and struck with great force with the front of Vehicle A in front of Vehicle B (hereinafter: "the accident")."
During the hearing of the evidence, it was clarified, that this section of the indictment is based mainly on the testimony of the eyewitness Mr. Israel Zadok in his police interrogation regarding the number of deviations of the defendant from his lane, with the third deviation ending with the occurrence of the accident.
The witness Israel Zadok testified in his main interrogation:
"I was sitting next to my son who was driving the car and after we passed Amazia on the road I was looking towards the road towards the darkness, and then I saw lights approaching us, at a certain point I saw that the lights were tilting to the right to my side and then they came back and we continued to drive and he was approaching us and then there was a tilt of the car coming in front of me towards my right and the accident happened. From what I saw it seems to me that the car that turned right was just rising in the air at eye level or something like that, and I was afraid that we would all meet together in the event as well but the vehicles of the accident separated and we crossed in the middle.
...
Q. You said you noticed the lights, what can you tell us exactly what you saw and how many times you saw them?
A. At least once I saw it, I didn't interpret it as a deviation from the route, I didn't see lanes, there was darkness and maybe it's a bend in the road." (See his testimony of 8 January 2025, pp. 32-33, paras. 30-34,1-10).
