Judgment
- Introduction and Review of the Procedure
- Introduction - We have before us the plaintiff's claim, Mr. Khaldun Hamdan (hereinafter: "The Plaintiff"), which was filed against the defendant, Mr. Tair Hassan (hereinafter: "The Defendant"). The plaintiff claims in his claim that he is entitled to payment of various social rights deriving from his work at the "Al-Noor" bakery in the city of Acre (hereinafter: "The Bakery").
- The main controversy In Proceeding It is the question of the existence of an employee-employer relationship between the parties, and especially the question of the identity of the plaintiff's employer. In summary, we note that the defendant does not deny that the plaintiff was employed in the mafia, but he claims that the employment was done by other parties, especially the defendant's uncle - Mr. Nizar Hassan (hereinafter: "Nizar"), who is in fact the owner of the mafia.
- As for Nizar, who testified in the proceeding on behalf of the defendant, he reiterated that he served as the sole owner and manager of the bakery (however, he refrained from addressing the plaintiff's claims on the merits of the matter, and in relation to the social rights claimed by him), and that the defendant had no actual connection to the mafia.
- We would also like to note that in light of the defendant's claim that he does not serve as the owner of the bakery, on February 26,2026, the plaintiff filed a separate lawsuit against Nizar (Labor Dispute (Haifa) 86066-02-26hereinafter: "The Additional Procedure"). Since Nizar did not file a statement of defense on the date set by the court, a judgment was issued on June 18,2026, on the basis of the statement of claim. On August 24,2026, Nizar filed a motion to annul the judgment, which was forwarded to the plaintiff's response, which was recently filed, and was scheduled for a hearing before the presiding judge in November 2026.
- It should be emphasized Because In a judgment This is not discussed by the plaintiff's claims against Nizar and as raised in the additional proceeding, nor by Nizar's arguments in his motion to annul the judgment or in the plaintiff's response. To be precise, this is a separate and different proceeding, and the arguments of the parties Name And as was raised therein, they have not yet been heard by the court at all, on the merits of the matter.
- Review of the (current) procedure -
- On March 25,2024, it was submitted by Mr. Yousef Abu Obeid (hereinafter: "Plaintiff Yosef") a claim against the defendant (Labor Dispute (Haifa) 57503-03-24);
