Decision

I have before me a motion to certify a class action under  Section 5 of the Class  Actions Law, 5766-2006 (hereinafter –  the Class Actions Law).

In summary: the respondents are the managers of "lottery clubs". The application for approval concerns two types of claims against them: a claim that the respondents' activity is illegal; and claims that the respondents mislead their customers, by act or omission, regarding the quality of the product or service sold to them. As will be detailed, the request for approval is granted in part, with regard to the deceptive claim (as will be explained, subject to the identification of an alternative class plaintiff). The motion to conduct a class proceeding on behalf of the respondents' clients with respect to the claim of illegality is denied against all of the respondents.

Introduction

  1. The respondents are "lottery clubs" – companies that market individual and group participation in the lottery lotteries of the National Lottery, so that they commit to customers to purchase lottery participation tickets, which, if they win the lottery, will generate income for the customers.
  2. The service offered by the respondents to their customers includes filling out the lottery forms individually and in groups, sending the forms, tracking the winnings, and sending the winning money to the customers.
  3. As for "group participation" in lotteries – which is ostensibly their main activity: it is about allowing the customer to participate, together with others, in a number of lotteries. If participation in the lotteries or part of them yields fruit, the participant receives a proportional share of the winning amount according to his relative share in the "buyers' group".
  4. This engagement format is presented in the publications as particularly attractive. The respondents' publications are not uniform, but in most of them it is noted that the company is assisted by experts and that it has statistical methods for selecting numbers that can increase the chances of winning the lottery. Accordingly, the customer is offered, inter alia, a service in which the company selects the numbers in the lottery form or part of them for the customer.
  5. The Ottoman Settlement [Old Version] 1916The following are the clubs operated by the various respondents:

12-34-56-78 Chekhov v. State of Israel, P.D. 51 (2)Respondent No. 1 - Lutont Members' Club Ltd., operates the "Lutonet" club (hereinafter also – Lutonet).
