Two more days later, on October 29,2024, Tal and Sapir corresponded again regarding the signing date. Sapir asked in the message, "Will we be able to sign this week, do you think? Tal replied: "I wish. I'm doing a check." Later that day, Tal wrote, "Progressing... there's a situation this week." In another voice message from the same day, Tal noted that he had spoken with Racheli and Lihi, and that Lihi was "sorting everything out, " and added, "I hope we'll sign on Thursday, and if not, Sunday" (Exhibits 27-28 of the plaintiff's exhibits).
On October 31,2024, Tal contacted Sapir in a message and asked, "Is there an update regarding the signing date? ". Sapir replied that he "very much likes to go to the signatures, " and noted that "yesterday or the day before yesterday they transferred the payments to Lihi and so on... I understand that it is in motion." Tal replied by means of a smile in the form of a flower, and immediately afterwards Sapir wrote, "It will be signed very soon" (Exhibit 35 of the plaintiff's exhibits).
As noted, a few hours later, Sapir informed Tal that the defendant had decided not to sign the agreement.
The sequence of proceedings after the defendant's announcement that he had decided not to sign the agreement
On November 24,2024, the plaintiff, through her attorney, sent a warning letter to the defendant, in which she demanded that he fulfill the "agreement that was formulated with my client" (paragraph 10 of the letter; the letter was attached as Appendix 43 to the plaintiff's exhibits). On December 8,2024, the defendant replied, through his counsel Lihi, that the negotiations between the parties were extremely short, that a final draft of the agreement had not been formulated, and that the terms of payment had not been agreed upon between the parties. The defendant further stated that he and his wife had decided to cancel the transaction, due to personal circumstances that had been discovered to them, which, according to them, were liable to leave them homeless.
