אזרחית מולדובה, השוהה בישראל ברישיון מאז 2006 ואשר בקשה לחידוש אשרת שהייה המאפשרת את עבודתה בענף הסיעוד נדחתה על ידי משרד הפנים וכך גם עתירתה לבית המשפט לעניינים מנהליים, ערערה לבית המשפט העליון ובד בבד הגישה בקשה למתן צו ביניים בטענה כי אם תגורש מישראל, יסוכל הערעור. לטענת המערערת, משרד הפנים דחה בקשתה ללא כל מסמך המעיד על הסירוב בעוד שמשרד הפנים טוען כי בקשה כאמור לא התקבלה אצלו. בית המשפט העליון קבע כי אין לגרש את המערערת עד להחלטה בערעור, הואיל והתוצאה המעשית של הרחקת המבקשת מישראל עלולה להיות איון אפשרותה לחזור לישראל אף אם יתקבל ערעורה ובכך יהפוך הערעור שהגישה לעניין תיאורטי.
