In addition to the impression of fairly calculated conduct on the part of Defendant 2, it appears that during the interrogation he is the one who leads the investigators. At the very beginning of the interrogation, Defendant 2 asked , "What do you promise me if I give it to you?"and made his story conditional on the same promise (P/11, pp. 1, 28-29); and even after he began to give his version, he stopped from time to time and tried to get promises, when at first he asked for promises to protect his life and the lives of his family, as someone who was ostensibly frightened and threatened by Defendant 1 and others; and later he explicitly asked that the commander of the Central Intelligence Unit promise that nothing would happen to him legally, and that he would remove him from the file.
And so, after the commander of the Central Intelligence Unit said that he had to appear before Defendant 1 and hurl things at him, Defendant 2 asked, "Well, and I'll tell him this... Are you helping me? You are getting me out of this" (ibid., at p. 13, paras. 5-8). Later on, the conversation between the two proceeded as follows:
"Defendant 2: And nothing will happen to me?
Commander of the Intelligence Unit: Maybe you will be a little unpleasant and you will pass and have to testify and everything.
Defendant 2: The thing about the testimony about my dick... Let him go fuck me. (unclear word) My life...
Commander of the Intelligence Unit: Your life, your life, we don't want to promise you things that are not in my control... Listen, because you still have some kind of involvement here, I can assure you that I will do everything to the maximum, and because you go and tell us the truth, the State Attorney's Office, the police, will take you into consideration and go with you as much as possible. All right?
Defendant 2: Will I go to jail?
Commander of the Intelligence Unit: I hope not. Step by step, but listen carefully, a lot depends on you. Look at me, look at me, a lot depends on you and your behavior and your testimony and your strategism and your truth and your cleanliness a lot depends on that... Luckily for us, this conversation happened here, because it was a matter of time, another day, two days, three more days, in the end, we know everything. Right? And then you would get into a system of complications where you complicate your lie and then your situation is much worse, but now, thank God, we're not there.
