A: It is not written.
Q: It is not written.
A: It doesn't say but it says it's exceptional. Exceptions are enough for me.
Q: Are exceptions enough for you?
A: Enough for me
(p. 81).
- Shlita was also confronted with other "references" by other scholars, who were mentioned in his opinion as follows:
- With regard to Prof. Nino Quenzali, mentioned on page 14 of his opinion, it turned out that the reference to him was through an article on the News1 website (the name of the appeal was changed 20 – Yifat Gadot, November 8, 2004), and he admitted that he did not look at this article and that he was looking mainly at "...on the reports and the studies" (in detail on pages 239-241) (see also Exhibit M/13).
- He was referred to page 9 of his first opinion (below the table) where it was written about a study by Dr. Bar Hanna and Professor Tamar Peretz , he was asked if he had read the article and replied that "...I can't tell you now, I don't remember. I wrote somewhere I read?.... I don't remember at the moment" and later confirmed that"...I did not write it, that is, I did not rely on it" (pp. 242-243 and also on page 246).
- Later, regarding a 2006 Ministry of Health report mentioned on page 9 of his opinion, which is not mentioned in his list of sources, he was asked if he had read it, and he replied:
Q: Look, you already told us at the beginning of the investigation that everything you looked at and read for your opinion appears in your list of sources.
A: Yes. It could be that I didn't write something in the list of sources, I read it and I didn't.
Q: So how do you know you've read it?
A: How do I know that...
Q: So you don't remember.
A: Right now I can't tell you how I know. Chances are, if I was interested in it, I read it.
(p. 243).
- Similarly, and in this spirit, his answer was in relation to other scholars mentioned in his opinion:
Regarding Dr. J. Dickstein: "... What is written here, I took from somewhere....No, I don't know at the moment, at the moment I don't know, but I copied it from somewhere" (page 244).
