Summary of the disputes, and the manner in which the verdict proceeds
The accuser chose to present the body of evidence in her possession in a layered manner, with each layer relying on those that preceded it and adding a new layer of evidence and findings, until the overall picture is formed. The first layer of the evidence presented is intended to prove the very occurrence of the murder incident, and focuses on the scene of the murder in Ben Gurion Square in Lod and the specific events that took place there. The second layer deals with the connection of the vehicles involved to the murder incident, that is, it seeks to establish the involvement of the residents of the Mitsubishi and Toyota in the planning and execution of the murder. The third layer seeks to link these vehicles to operational phone numbers that were located during the investigation, and in more detail to substantiate the claim that during the relevant hours on the day of the murder, one of the Toyota occupants used a phone number 054-4439141 (hereinafter: "141"), while in Mitsubishi a telephone was used at 050-3119685 (hereinafter: "685"). The fourth evidentiary layer is intended to establish the connection between the defendant and the operational phone number 685, and between the defendant and the Mitsubishi, on the relevant dates of the murder. Another chapter in the exhibits file and the accuser's summaries is devoted to additional complicating evidence, as well as to the defendant's versions, his reliability and the contradiction of his version in his testimony in court by means of conspiracy evidence.
An examination of the detailed summaries submitted by the defendant's counsel, with what is in them, and to a large extent also what is not in them, shows that in fact they do not dispute what is alleged in the first three layers detailed above. There is no dispute as to the location and manner of the murder, and the defense's summaries are based on the assumption that the murder was indeed committed in Ben Gurion Square in Lod, in the manner described in the indictment. There is also no dispute that the residents of the Mitsubishi and Toyota took an active part in the murder, and cooperated with each other throughout the day, before and after the murder. Thus, for example, it is clarified in paragraph 45 of the defense summaries that there is no dispute that immediately after the murder, the two vehicles met on a dirt road near the municipal sports complex, where the passengers of the Toyota set fire to their car and entered the Mitsubishi, which fled the scene. As for the third layer, there is not a single word in the detailed defense summaries that undermines the claim that the perpetrators of the murder used the operational phones mentioned and that phone number 141 was in Toyota while phone number 685 was in Mitsubishi. The fact that the defense does not deny the first three layers was even explicitly clarified in the completion of the oral summaries in the minutes of November 5, 2025.
