The visit to Hummus Khalil and the alibi claim
I will briefly mention the sequence of events in relation to the alibi claim, in order to understand the many developments that have taken place on this issue throughout the investigation and the trial. At first, during his many interrogations with the police, the defendant implicitly refrained from providing any information regarding his actions on the day of the murder. During the interrogation, the defendant was given many opportunities to tell where he was and what he did in the morning and afternoon hours of 26 August 2022, but he falsely claimed, time after time, that he did not remember his actions, even though he was first asked about it only a few days after that date. Therefore, all of the alibi versions provided below are suppressed versions, without any convincing explanation given for the suppression, and as such their evidentiary weight is low from the outset.
If that were not enough, even after the defendant decided to raise an alibi claim, it was not a uniform and permanent version, and over time it underwent changes and developments, to which no convincing answer was provided. Thus, the defense initially gave a sweeping and laconic heresy, without any positive reference to the defendant's actions, and only after the court commented on this was a supplement submitted to its response, according to which "on August 26, 2022, at 7:00 A.M., the defendant left his house together with another, in a Mazda car. THE DEFENDANT AND THE OTHER DROVE TOWARDS THE CITY OF BE'ER YA'AKOV - THE WHOLESALE MARKET IN TZRIFIN, IN ORDER TO PURCHASE FOOD (HUMMUS, FALAFEL, TAHINI, ETC.) BY TAKE-AWAY FROM THE KHLIL RESTAURANT OF THE TZRIFIN BRANCH. After the defendant and the other received the food they had purchased at the Khalil restaurant, the two went out in the direction of the defendant's house, driving in the Mazda. The two arrived at the defendant's home between 8:10 and 8:15 a.m. The defendant did not leave his house until 2:00 P.M., when he went out with another, driving a white Mercedes."
