The same picture emerges from the WhatsApp conversations between subscriber 685 and subscriber 054-6080052, which includes business correspondence that began on July 21, 2021, continues on dates when the defendant admits to using the subscription, such as August 18, 2022, August 20-23, 2022, and is also demonstrated in two WhatsApp conversations on August 28, 2022, at 18:53 and 18:56. Here, too, the conclusion is that the defendant is the one who holds the 685 subscription, and is in contact, even before his arrival in Haifa, with the same person with whom he has business relations [P/187 - Part One - section 6(d) and the raw material marked M.K. 7]. Additional examples can be found in the conversation on August 28, 2022 at 18:48 with the subscriber 054-4992213, with whom extensive business correspondence has been conducted since July 26, 2022, including the identification of the defendant by name on July 31, 2022 [ibid., in section 6(e) and in the raw material marked M.K. 9], and in the many business conversations throughout August 28, 2022, with subscriber 557, with whom he has been conducting a long-term business relationship, since August 3, 2021 [ibid., in section 7 and in the raw material marked M.C. 11]. Another indication can be found in the screenshot located on phone A32 on August 28, 2022 at 12:01 p.m., of entering the Mizrahi Tefahot Bank application, with the inscription: "Good afternoon Ayman" [ibid., in section 9(b) and in the raw material marked M.C. 14].
I will conclude this chapter with the determination that the objective investigative materials collected refute the defendant's versions regarding the meetings with Samer, their place and dates, and testify that subscriber 685 remained in his possession throughout the weekend - both on the day of the murder and in the days following it - and was not handed over to Samer, as the defendant sought to convince in his suppressed testimony in court. I will now examine the last part at the core of the defendant's version of innocence - the alibi claim on the day of the murder.
