As may be recalled, the defendant himself testified that at the time he was interested in purchasing magnets for the business he owned, but claimed that he did so only on the day of his arrest, 29 August 2022. In practice, as can be seen, on August 28, 2022, at 13:13, the defendant received from Wasfi the details of a company engaged in the marketing of magnets, and two minutes later he called the same company from a 685 subscriber. The only plausible explanation is that the 685 subscriber was also held by him at the time, alongside the 401 subscriber, since the information in relation to the telephone number reached him directly, and the person with an interest in that call was him and him alone. The proximity of the times, a gap of only two minutes, also leads to the same conclusion, and there is no alternative explanation that would in any way link Summer to the making of that phone call. This circumstantial evidentiary mask therefore directly connects the defendant to the possession of subscription 685 in the afternoon hours of Sunday, August 28, 2022, while he was in Tel Aviv, many hours before his arrival in Haifa and the alleged meeting with Samer. From now on, in addition to the evidence that there was no transfer meeting on Thursday and no return meeting on Sunday, and in addition to the evidence that the defendant, himself and no one else, held the 685 subscription on the day of the murder, there is also corroborating evidence that substantiates the defendant's possession of the subscription throughout the weekend as well, contrary to the defendant's claim that the phone was in Samer's possession at the time.
To be precise, the telephone conversation of August 28, 2022 at 13:15 is not the only evidence in this context. Alongside it, we can point to other strong evidence. Thus, for example, the intensive correspondence on WhatsApp with subscriber 652 on August 28, 2022, from 11:55 a.m. until the announcement I mentioned earlier, "This is new to me," heralds the replacement of the SIM to subscriber 761. As appears from the analysis of the media data, the contact with Subscriber 652 began on February 21, 2022, and includes long-term business correspondence, including in matters of invoices, invoices, prices for diesel, payment vouchers for accountants, and more [P/187 - Part One - Section 6(a) and the raw material marked M.K.2]. For the avoidance of doubt, part of that correspondence is carried out on the dates on which the defendant himself confirms that subscriber 685 was in his possession, such as 23 August 2022, and the fact that the sequence of business correspondence continues throughout the day of 28 August 2022 testifies to the fact that on this date as well, subscriber 685 was in the possession of the defendant, and not in Samer's possession, which has no alleged connection between him and the defendant's business.
