301A. (a) Whoever intentionally or indifferently causes the death of a person in one of the circumstances detailed below, shall be sentenced to life imprisonment and this punishment only:
(1) The act is done after planning or after an actual process of weighing and formulating a decision to kill;
In the present case, the objective element alleged in the indictment in relation to causing the fatal result is an element of "intent", and it seems that this element has indeed been proven to be sufficient in view of the large number of shooters and weapons, at least two shooters and two pistols, for the close range of the shooting, from a distance of a few meters, the number of shots fired, at least 9 bullets, and the fact that the shooting was aimed directly at the upper body of the deceased. who sat exposed on the driver's seat of the Hyundai and the location of the injuries to the car and the body of the deceased, to the left chest and left hip. Such a series of actions leaves no room for doubt as to the intention of the shooters - the intention to cause the death of the deceased, and not only to cause him any injury or injury. Beyond what is required, in this case the presumption of intent is in full force, since the death of the deceased was a natural and probable result of the deliberate and massive shooting, with a level of certainty far beyond probability.
With regard to the aggravating circumstance concerning the planning of the act of killing, the matter is also simple, and it seems that there is no need at all to examine the more lenient alternative of establishing a "real process of weighing". From the evidence detailed above, it is clear that the act of killing was carefully and extensively planned over a long period of time, days if not weeks. As detailed above, a number of people, at least four, joined together, divided the duties among themselves, and equipped themselves in advance with stolen vehicles, fake identification plates matching the models of the vehicles, matching weapons and ammunition, combustible materials to set fire to the Toyota, and clothing and camouflage devices. Moreover, those involved in the act worked in advance to formulate a detailed plan regarding the manner in which the murder would be carried out, by following the deceased on horseback when he left work, or when he returned from work, and the execution of the murder plan in an area near his home, so that after the completion of the act, it would be possible to meet on a nearby dirt road that had been agreed upon in advance, where the Toyota would be ignited, and the Mitsubishi would pick up the perpetrators and flee the area. Moreover, in order to build and implement the plan, a period of preparation and study was also required, during which a great deal of information was collected regarding the deceased's movements, his place of residence and place of work, his working hours, at least on Fridays, a suitable meeting point was examined and a suitable meeting point was identified, and ways of escape were identified and a place where the Mitsubishi would be kept "in refrigeration". Such an extensive investment of resources and time, such complex and meticulous planning, obtaining so much and varied information, and the manner in which all of these were put together and implemented in the murder, which was carried out with horrific efficiency in a matter of seconds, all of these clearly indicate that this was an act of murder that was carried out after careful and careful planning, determination and cold blood. The early planning, the lengthy preparations, and the considerable investment of resources also attest to the element of "deliberate" killing, and confirm the conclusions detailed above in light of the manner in which the shooting was carried out in those last seconds in the square.
