An assassination squad, in which the defendant and his accomplices, who were traveling in the stolen vehicles, ambushed the deceased's car on the morning of 26 August 2022, but the murder was finally carried out only in the afternoon, after the members of the assassination squad followed the deceased on his way back from his workplace in Holon to the vicinity of his home in Lod. Then, when the deceased arrived at Ben Gurion Square in Lod, the Toyota blocked his lane, and the two assassins got out of the car and shot the deceased dead, while the defendant slowly passed by them while driving a Mitsubishi. After the murder, the two vehicles involved drove to a nearby meeting point, where the shooters' car was set on fire, and they were loaded into the defendant's car, which was hidden later in the day in a parking lot in Tel Aviv. Three days later, the defendant arrived at the same parking lot with two of his family members, and together they replaced the vehicle's duplicate license plate with the original license plate and loaded the vehicle onto a tow truck ordered by the defendant. At this stage, the three were arrested by the police, and the defendant has been in custody ever since.

For the acts detailed in the indictment, the following offenses were attributed to the defendant: intentional murder under aggravated circumstances together - an offense under section 301(a)(1) together with section 29 of the Penal Law, 5737 - 1977 (hereinafter: "the Law"), conspiracy to commit a crime (murder) - an offense under section 499(a) of the law, carrying a weapon and ammunition together - an offense under section 144(b) of Risha and Saifa together with section 29 of the law, Destruction of evidence together - an offense of section 242 together with section 29 of the law and obstruction of justice together - an offense of section 244 together with section 29 of the law.
The defendant denied everything attributed to him and claimed that at the time of the murder he was at his home in Ramle and that at no stage did he drive or drive the Mitsubishi car that was allegedly involved in the murder. More extensive details of the defendant's versions and the responses given on his behalf to the indictment will be brought below. In any event, in view of this position of the defendant, all the evidence was brought before us, most of it by consent in the framework of the detailed and extensive exhibits file that was submitted, and some of it by way of a frontal examination of the witnesses in court. For this, we are grateful to the counsel for the parties, who conducted the proceeding with remarkable professionalism and efficiency.
