"Q. WhenThe Plaintiff was at Beit Levinstein in rehabilitation, had the opportunity to travel to the center and there was an offer that you bring a' and the plaintiff Refused?
- Because of me, she refused. I was at the time II--- At my brother's, it was during pregnancy and I did it with The minor Fun Day Name, he has 3 children.
The plaintiff wanted to see the minor. As soon as she heard that I was with the minor, she gave it up and we went back home.
The plaintiff admitted to this matter, but claimed that the reason for this was the treatments she received, and these are her words
(p. 28, paras. 21-29 of the transcript):
"We're talking here when I was hospitalized at Loewenstein Hospital in a wheelchair. In the middle of the day, when I have a schedule from morning to afternoon of treatments, the defendant informed me in the middle of the day that on the wayB was coming with the minor for a fun day in Tel Aviv and if I wanted, B could bring the minor to the hospital. We also have a sneak peek at it in my exhibits. The defendant and I unanimously decided thatthe defendant would bring her to the parents in the north and not to the hospital.
First of all, I need an escort who will be close to me. Second, I'm not sure they would have let me go out or let the minor in as far as the staff is concerned, I'm in treatment. I added this of course later in the conversation with the social worker, but the main emphasis here was that I couldn't go out to the minor or the minor couldn't go to the hospital during treatments.
The answer indicates that the plaintiff did not examine with the staff the possibility of meeting the minor at all (by saying, "It is not certain that they would have let me go out or let the minor in as far as the staff is concerned"). This is despite the fact that in her situation she was expected to take advantage of every opportunity to have a relationship with the minor.
- When the defendant left the rehabilitation framework and moved to her parents' home in the north, she met the minor only about three times, when the defendant's spouse made sure to stay in the car so as not to disturb her, and she testified as follows (p. 126 of the transcript):
- There were times, At least 3 undisputed times that you drove north The Defendant And you brought theThe minor to the plaintiff?.
- We brought the The minor But The Plaintiff She never saw me thereI would wait in the car until they finished. We used to do trips before so I didn't drive there very much. The tension is not unequivocal for me.
- If the plaintiff also testified about the low frequency of contact after the accident (p. 99 of the transcript):
"She was in the hospital. My husband and I didn't see the minor during that time. There was no one to bring it. The plaintiff saw her once, two or three times.
