Verdict

Muhammad Azzam, a resident and citizen of the State of Israel, is on trial on charges of membership in a terrorist organization, an offense under Section 22(a) of the Counter-Terrorism Law, Appeal to the Committee - 2016 (hereinafter: the "Counter-Terrorism Law")

Background

On August 8, 2024, an indictment was filed against the defendant accusing him of membership in a terrorist organization in accordance with section 22(a) of the Counter-Terrorism Law.

  1. As described In the general part of the indictment, the global jihad organization "Islamic State" (hereinafter: "the organization" and/or ISIS) was declared an illegal association by the Minister of Defense on September 3, 2014; and was declared by the Government of Israel on October 28, 2015, and it is also declared as such by virtue of the Counter-Terrorism Law.

The origin of ISIS is different from that of al-Qaeda in Iraq, which is one of the main rebel forces operating in the jihad arena in Syria, and as a highly radical terrorist organization that is one of the global jihadist organizations.  The organization's doctrine supports the Salafist jihadist ideology, which calls for harming "infidels" regimes that do not follow the path of Islam.  Israel, as part of the "infidels," is a clear combat target as part of the goals of global jihad.

The jihadist inspiration, which has made the West a target for terrorist attacks "created by" ISIS and Al-Qaeda, has become especially tangible in recent years, with a series of attacks in Europe, the United States, and Russia.  Some of the attacks were carried out independently by means of a "lone terrorist" or by a group of operatives  without ISIS's clear direction.   The organization's ideological base continues to gather supporters in Israel and around the world, in part in light of the organization's extensive investment in advertising and information on social networks and dedicated and encrypted media applications, for the purpose of inspiring, encouraging, and providing directives to activists on the ground, along with practical training of activists on the ground for combat.
