Before the court, a claim by a car buyer to cancel the purchase of the car as well as the cancellation of loan agreements she took for the purpose of financing the purchase of the car.
Submission of pleadings and hearings
- On August 21, 2023, the plaintiff filed a statement of claim in which she requested to cancel the purchase of the vehicle, as well as loan agreements she had taken for the purchase of the vehicle, as well as compensation in the sum of NIS 50,000. Defendant 1 (hereinafter: "Elboim") filed a statement of defense on November 13, 2023, defendant 3 (hereinafter: "Blender") on January 4, 2024, and defendant 2 (hereinafter: "Direct Financing") on January 7, 2024. The court issued an order to submit evidence on March 8, 2024. The plaintiff submitted her evidence, after being warned, only on April 30, 2024. Blender submitted her evidence on June 5, 2024, Elbaum, after requesting and receiving an extension, on June 10, 2024, and direct funding on June 16, 2024. The first hearing took place on September 15, 2024, in which the court prepared the hearing of the evidence. The second hearing took place on March 13, 2025, in which the plaintiff herself, her mother, her daughter and her brother were interrogated. On behalf of Elbaum, Mr. Yehuda Elbaum, on behalf of direct financing Ms. Shelly Amsalem, and on behalf of Blender Ms. Noa Dick (hereinafter: "Yehuda, Shelly and Noa"). The transcript of the recorded hearing was received on April 8, 2025, and on the same day the court published the minutes and issued an order to submit summaries. The plaintiff submitted her summaries on April 18, 2025, Blender on April 29, 2025, and Elboim and Direct Funding, after being warned, on May 29, 2025, and properly on May 30, 2025 (Elboim) and June 1, 2025 (Direct Funding).
Discussion and Decision
- The court must determine whether the plaintiff's car purchase agreements and loan agreements that she took for the purpose of financing the purchases of two vehicles that she purchased should be canceled, and if so, what remedies should be given to the plaintiff. The plaintiff's arguments
- The plaintiff claimed in the statement of claim. Because she is divorced and a mother of four children and lives in the city of Nazareth, Elbaum deals in trade and brokerage in used vehicles, Direct Finance deals with providing financing and non-bank loans, and among other things, deals with providing loans for the purchase of vehicles against the mortgage of the vehicles and a blender
