In this regard, Rotem Shushan, director of network training at the partnership, testified at p. 674, lines 3-13: "He [Sol-Y.G.] renovated it, he made the bar... In the renovation [of the partnership between 17, after the evacuation of Sol in 16 - Y.G.], what did we do? We moved it [the bar that Saul made - Y.G.]... We did a different bar... We moved it, changed the location... We changed its shape."
Thirdly, no reading receipt was presented about the cost of renovating the bar. In his testimony on page 556, line 13, Sol referred to the invoice of MK Carpentry - which was attached as Appendix 24 to his affidavit. The entire Kabbalah is blacked out and cannot be read. The court stated this explicitly at p. 556, line 30. Despite this, from November 4, 2021 until the end of the trial, no reading receipt was presented to the court, and no representative of MK Carpentry was invited by the plaintiffs to testify regarding the amount of the cost of renovating the bar in the café.
Fourth, Saul testified on page 558 of the transcript of line 26: "I made a new bar... I brought new tables and chairs."
The café's bar stools and tables were taken away by Saul upon evacuation, and were not left in the café. Saul testified in his interrogation at p. 445, lines 1-13: "The only thing I took from this business [before the date of the eviction - Y.G.]... Tables, chairs, gas, things that I could sell for a bit, a little to cover for [the debts - J.G.]... equipment that is not permanent..."
- Sol and Sol's claim for payment in the amount of ILS 2.5 million + from a tax appeal regarding an expected profit of approximately ILS 64,000 per month from the date of eviction until the end of the contractual lease period of the café on September 30, 2020 is dismissed, for the following reasons:
First, Sol and Sol base the claim on Exhibit N/3 - the partnership's profits from the café in the period from Dec. 14 to May 15, prior to the signing of the franchise agreement and the sale agreement between the partnership and Sol.
