Saul admitted in his interrogation: "Q. ... If you were presented with a presentation of what the profits of the café were before you entered, it doesn't say anything about what the profits in the café will be about, when you manage it? A. Correct" [p. 569 of the transcript, lines 7-9].
It is not possible to derive a future expected profit for Sol, from the past profit of the partnership when it operated the café from Dec. 14 to May 15, especially when counsel for the plaintiffs stated on page 11 of the transcript line 19: "From August 1, 2015 to December 31, 2016, during the period when they [Sol-Y.G.] operated [the café - Y.G.] there was no monthly profit. There were losses."
See the testimony of CPA Wolf, on behalf of the plaintiffs, on this matter, at p. 138 of the transcript, lines 2-4:
"Q. During the period when he [Sol-Y.G.] operated it [the café - Y.G.] for all the months, did he lose? A. That's right."
According to this statement, since Shabbar Sol lost a period of one year and 5 months, when it operated the café, and since it had no profits , the claim for payment of ILS 2.5 million [withholding expected profit] for the period after the date of the eviction is baseless.
Second, Sol testified in his interrogation that on 6 July 2015, at the time of the transaction with the partnership, he was 25 years old, and had no experience in operating a café. This matter also has weight when compensation is claimed for the prevention of future loss of profit after the evacuation of the café.
Saul testified during his interrogation: "I was about 25 years old... Q. What were you involved in at that time? A. The truth is that at that time I was unemployed. Q. ... And before that, what did you deal with... A. Before that, I had a period of some time in real estate brokerage" [p. 320 of the transcript, lines 13-18]; "How many years have you been involved in real estate? A. About a year. Q. And what else did you deal with before? A. Before that, my father and I had a joint business, and when I was discharged from the army, it was a sandwich bar. Q. So did you have experience in the field of food? A. I had no experience because I was 21 years old... My father was there, and he took on a very, very big part in the management. I'm a business manager, I would make the sandwiches and help where needed... The business was... about a year and a half" [p. 321 of the transcript, lines 1-25].
