Moreover, it should be noted that the defendant had no criminal record at the time of the murder and testified in court, and before that he had not been interrogated by the police and his fears and crying were evident during his interrogations with the police.
During his testimony in court, Defendant 2 described why he did not speak the truth in my interrogations with the police (P. 26 December 2022, p. 362):
"Adv. Ben-Natan: Okay, okay. You are arrested two weeks later on 15/7. How did you behave during the interrogation?
The witness, Mr. M. Asswi: I lied to them, I started screaming, I cried.
Adv. Ben-Natan: Why did you cry?
The witness, Mr. M. Asswi: I can't talk, to incriminate a human being for no reason. My brother was murdered, if I speak up and accuse him and he didn't do it, they'll murder another brother of mine. I don't want to lose more brothers, enough.
Adv. Ben-Natan: So you didn't want to incriminate." (P. 26.12.22, pp. 362, s. 31 - p. 363, s. 5).
Defendant 2 goes on to describe that he does not know the deceased and adds , "We did not avenge my brother's blood, for me I will go to help Muhammad in a case that is not mine, my brother's blood we gave up."
Defendant 2 explains that he cried at the police and lied that he could not speak and incriminate a person, since he had already lost a brother and was afraid that another brother would be murdered if he told the truth. Defendant 2 went on to explain that he did not know the deceased and his family.
The defendant also said that his mother's sister lives in a girl, but he never drove there. Defendant 2 said that he knew from rumors that Muhammad had been stabbed in the face by the deceased and that he wanted to take revenge, but noted that he did not care about it. Defendant 2 was asked if on the day of the murder when he went down to the south he knew that Muhammad intended to harm the deceased, and replied that if he had known about the intention to murder he would not have arrived with his jeep, Ituran, and slippers, and as he said:
