Arriving at the murder scene in flip-flops with a personal cell phone, a personal car and a locator
At the same time, in the partial version given by defendant 2 during his interrogation – P/12B, the defendant gives in a manner that sounds spontaneous nevertheless one factual detail that can be considered to be of considerable significance, and which will be more convincing that his statements, which he misled and did not know details, are not detached from the reality that actually occurred.
Thus, in the course of his statements in his interrogation (P/12B), defendant 2 tells his interrogator : "No matter where I know we are going to do such a thing, I would have taken my phone, I would have driven in my car....... with Ituran" (ibid., pp. 42, paras. 6-13), and as it became clear from the evidence, when the defendant drove south and met with Muhammad in the area of Lakiya at the meeting point shortly before the murder, defendant 2 did indeed carry his cell phone on it, and he also drove to the scene in his car with the Ituran device installed on it, and arrived at the Dor Alon station in flip-flops and light clothes (Observation Report P/66, p. 1).
These things in themselves will raise a considerable chance that when the defendant chose to go to the southern region with his phone and his car with an Ituran device on it, he did not exactly intend to be part of a murder (and this is also evidenced by the answer of the interrogator, who responded and said that it was strange to him as well).
It should be noted that even when he was traveling to the Occupied Territories to fetch the Mazda, Muhammad drove in his car, which had an Ituran device and his cell phone.
Moreover, as noted above, the evidence presented showed ample evidence that as far as Muhammad himself was concerned, Muhammad chose to act with great "sophistication," while trying to conceal details. Thus, Muhammad chose to travel to the Occupied Territories and bring his Mazda car that did not belong to him to be used for the murder, and he also chose to leave his phone in Lod and used an "operational" phone at the time of the murder, Muhammad took care of the burning of the Mazda car after the murder and even tried to arrange pictures at a gas station that would serve as an alibi for him.
