It should be emphasized once again that since there is no dispute that Defendant 3 was not a partner in the initial contact with Muhammad, and that he was brought to the "incident" by Defendant 2, who was the link between him and the others involved, it appears that any erosion of the evidence against Defendant 2 will act as aforesaid, a similar action on Defendant 3 as well.
As is well known, the defendant's lies alone will not be able to substantiate evidence for a conviction, but under certain conditions they will be able to assist other evidence.
Summary with regard to the statements of defendants 2 and 3 in the police
According to counsel for defendants 2 and 3, even if it is determined that the lies of defendant 2 will deter him, the accumulation of circumstantial evidence will not be sufficient to convict him of murder, and his lies will not be able to fill the large void in the evidentiary infrastructure that stands against him. As a rule, this should not be accepted as a categorical claim, and it can even be said that there is weighty evidence against defendant 2 and not other evidence in his favor, which is learned from his statements to the police, and from the manner in which he carried out the actions detailed in the indictment (with his mobile phone, in his car with a locator device on it, and in flip flops), his situation was much more problematic.
In the aforesaid circumstances, it can be determined that Defendant 2's version in his initial police interrogations contradicted his statements in court, but his version in his fourth police interrogation does not directly contradict his statements in response to the indictment, and to a certain extent it can even be found in it real hints to the version presented in his testimony in court. It can also be said that his well-founded statements to the police, according to which he committed his actions while carrying his mobile phone on him, and driving his car with Ituran on it, will make it difficult for the court to determine that he lied to the police when he claimed that he did not know that it was a murder plot.
