As for defendant 3, it can be determined that after he is not connected to the conspiracy offense, the evidence against him is supposed to establish the offense of aiding and abetting murder only according to the indictment as well. There is evidence against the defendant relating to a meeting at the gas station, waiting at the meeting point and returning to Lod with those involved. The defendant remained silent at the police, and what he said did not directly contradict his suppressed version in his response and in court (with all the implications of the matter). His travel with his phone to the scene of the murder certainly aids him in his claim that he did not know of the intention of the murder as it does to Defendant 2, and as noted above, since it was brought by Defendant 2, it seems that any erosion of the evidence against Defendant 2 will also weaken the evidence against him.
Defendants' Versions 2, 3 in Court
Testimony of Defendant 2 - In court Defendant 2 testified in court on December 26, 2022 and January 10, 2023. During his main testimony (with regard to the accuser's claims regarding the cross-examination of Defendant 2 of October 25, 2022, see the chapter "Development of the Defendants' Versions" above), Defendant 2 described Muhammad's proposal regarding the "drug deal": "I feel like the suggestion, let's bring, there are some bags of Hydro from Beersheba, do you want to participate, let's make some money? Your brother is in the hospital anyway. Let's start scattering you and me, I'm bringing it to you, you're going to scatter. But let's pick it up from Beersheba, I went with it with my jeep, I have it in my jeep, I went with slippers." (p. 350, paras. 26-29), and when asked to explain, he said, "Bring him Haydo. He'll bring me a hydro to the place he told me to wait, and I'll take it with me to Lod." (P. 26.12.22, paras. 30, 31)
Defendant 2 explained why he agreed to travel with Muhammad to the Occupied Territories to get a car: "He told me let's go and get a car, because in Beersheba you know his vehicles. So I'm not going to steal a hydro in my jeep, I have a new jeep." Ibid., pp. 352, 25, 26).
