C.H. Alon Infeld:         You told him, you calmed him down at first.  It's significant.  A person says he doesn't want to.  And you could have told him, "Listen, in the middle of the interrogation I'm not going to stop," you could have told him that at the beginning, too.

Sgt. Eyal Saban:          Later on, we didn't allow him? I may have gone out to call the defense attorney.  I don't know how to say. 

According to the defense attorneys, as can be understood, investigator Eyal Saban did not have a satisfactory explanation for the conduct of the investigative unit and he tried to evade.  According to them, later in the interrogation, Investigator Saban left the room and Investigator Eyal Zeitun continued the interrogation, and he was also asked in court (9:11:20) about his conduct in interrogating the defendant by not allowing the defendant to consult with a lawyer, and he got into trouble with his answers when he initially stated that the defendant did not ask for a lawyer at all, and later replied that the defendant had asked for a lawyer but was told that when he was in front of an officer, he would receive the call to a lawyer after he was arrested.  The following conversation followed:

C.H. Ariel Hazak :   Usually when someone asks in the middle of an interrogation, they are told at the end of the interrogation.  And this is for the simple reason that according to the rules, at the beginning of the interrogation, a person is offered an attorney and then he has to give the answer yes or no.

Sgt. Eyal Zeitoun:  And he refused.

C.H. Ariel Hazak :   The big problem is that at the beginning of the interrogation you didn't really tell him what he was accused of.  You said "assistance" to him.

Sgt. Eyal Zeitoun:  That's what we knew.

C.H. Ariel Hazak :   You didn't tell him that it was aiding and abetting murder after the fact.

Sgt. Eyal Zeitoun:  We told him that aiding and abetting a serious crime and later we told him that it was murder.

C.H. Ariel Hazak :   What is next?

Sgt. Eyal Zeitoun:  During the interrogation."
