The informant went on to ask Muhammad, "Why didn't you go alone?" and Muhammad replied: "No, for the first time, he went out with me, I know him, he doesn't open up to me, I'm not afraid of him, I'm sure. Even if it takes 30 years, I am not afraid of it" (P/20A, p. 6) (my emphasis – A.H.).
In the aforesaid remarks, Muhammad emphasizes that defendant 1 "saw everything", i.e., was at the scene of the murder and saw the whole event. Muhammad also expresses full confidence in Defendant 1 that he will not tell about what he saw and will not testify against him. As mentioned, Muhammad's words to the informant were said in the framework of a friendly dialogue between the two, when Muhammad was in trouble, and many of the things that Muhammad said were consistent with many external evidence that was presented.
In the aforesaid circumstances, we will be obliged to determine that Muhammad's statements regarding the involvement of Defendant 1 in the murder, according to which Defendant 1 "saw everything" and would not say anything, will serve as weighty evidence against Defendant 1, that he committed the murder together with Muhammad, even if it is not possible to convict on the basis of this evidence alone.
The existence of a motive for defendant 1 - Counsel for defendant 1 further argued that the accuser wishes to determine that Muhammad had a motive for murdering the deceased, in light of the fact that in the past the deceased cut off his face, the problem is that the state did not present evidence that testifies to the motive of the defendant to join the murder, since defendant 1 is not a relative of Muhammad, and only his wife is Muhammad's cousin. Defendant 1 has no interest in participating in the murder since there is no close relationship between them.
During a conversation with the informant, Muhammad also told the informant things linking Defendant 1 to the murder.
During the conversation between the informant and Muhammad P/16A, Muhammad told the informant things that emphasized the close relationship between him and Defendant 1, in which he described details from which it is possible to learn about Defendant 1's real commitment to him, after helping and guiding him while he was dealing with the problem of using the drug known as "Nice Gay" and its results, and gradually persuaded him to switch to using "green", which according to him is an easier drug. Muhammad described how he "saved" Defendant 1 from addiction to "Nice Gay":
