Moreover, the settlement of Lakiya is located about eight kilometers from the settlement of Hura (and most of the travel is in a relatively open area, (see the maps attached to P/65), and it is not possible to mistake it for a single settlement.  Therefore, it is not possible that the defendant arrived in the settlement of Hura but mistakenly believed that he remained in Lakia.

In the aforementioned circumstances, when only about five minutes had passed from the time of the murder to the arrival at the meeting point and the northbound exit, it would be unreasonable to assume that Muhammad managed to arrive at the settlement of Lakiya after the murder to locate defendant 1, pick him up and bring him to the meeting point, which is east of the settlement of Hura, and all this for 5 minutes. 

I also did not find any logic in leaving Defendant 1 in Lakiya, and in complicating the entire operation of the murder, which required fleeing from the scene to the center of the country, for the purpose of proving an alibi (as detailed above), when, for example, Defendants 2 and 3 were left at the meeting point close to the settlement of Hura, and Defendant 1 could have stayed with them.

The aforementioned facts will also corroborate Muhammad's statement that he told the informant that Defendant 1 "saw everything."

In light of the above, it will not be possible to accept the version of defendant 1 regarding his disembarkation from the Mazda vehicle and its abandonment in the settlement of Lakiya.

In the aforesaid circumstances, when there is evidence that Defendant 1 left the Dor Alon gas station in Lakiya with Muhammad, and returned to the meeting point together with Muhammad, and there is no possibility that he was in the settlement of Lakiya during the commission of the murder, we will be obligated to determine that Defendant 1 was with Muhammad at the relevant time in which the murder was committed, and in fact he was in the Mazda vehicle at the time of the murder. 

Surveillance of the deceased's car in the Mazda vehicle  – As stated, on June 17, 2019, the day the murder took place, the Mazda vehicle that Muhammad had brought from the Occupied Territories was seen on the cameras of the village of Hura, driving following the deceased's vehicle until the murder was committed (edited video P/58, memorandum P/57, viewing reports P/59, P/60, P/61, P/62, P/63, P/63, P/69, P/70,  P/71 and P/72).
