With regard to the return to the meeting point (after the date of the murder), defendant 2 confirms in his testimony that when Muhammad arrived at the meeting point, Muhammad and defendant 1 "got out of the same vehicle" (F. 26 December 2022, p. 359, s. 31).  Defendant 3, for his part, confirms that Muhammad and Defendant 1 got out of the car together on their arrival at the city of Lod (p. 291, Q. 7) and hence Defendant 1 drove with them in the car and Defendant 3 does not describe picking up Defendant 1 in a place other than the meeting point.

From the aforesaid facts, evidence arises that defendant 1 arrived together with Muhammad at the meeting point.

In all the aforesaid circumstances, we will have to examine whether the version of defendant 1 that he  was left at the gas station in Lakiya by Muhammad, who returned to pick him up about an hour later (when the murder was committed), and that they drove to the meeting point with defendants 2 and 3 and then drove with them to Lod, is reasonable.

First of all, it should be said that the version according to which after leaving the Dor-Alon gas station to Kia, Defendant 1 was left in the area of Lakiya, contradicts the claim of Defendant 1 in response to the indictment in which he claimed that at the time of the alleged murder he was on his way to Lod.

Moreover, according to the video of the murder incident (P/58), the murder occurred at approximately 8:28 P.M.  According to the memorandum of Policeman Yitzhak Sharvit, dated 28 July 2019, based on an analysis of Ituran data for Defendant 2's vehicle (P/65), it emerged that Defendant 2's vehicle began driving from the junction point, east of the settlement of Hura, in the direction of Highway 6, at 20:32.  (Section 14) and indeed, according to the video documentation of the travel time from the scene of the murder to the point of the fire (P/151, P/151A, P/152), it appears that the travel time from the scene of the murder to the scene of the fire is 4.56 minutes.

From what has been said, it appears that defendant 1 drove together with Muhammad from the Dor Alon station (at 18:47) and returned with Muhammad about forty-five minutes later (at 20:32) to the meeting point, and he must explain and convince that he was not with Muhammad during that period of time, but he did not provide a convincing explanation for this.
