Moreover, from Muhammad's words to the informant, a very close relationship emerges between Muhammad and Defendant 1, and a strong relationship of trust, and in these circumstances, it is reasonable to assume that as far as Defendant 1 is concerned, Muhammad told Defendant 1 about the real purpose of his trip. It should be noted that as described above in the detention cell, Muhammad told two people (to the informant and Mr. Tareq Abulki'an (P/27A)), and there is a reasonable possibility that he also told his best and close friend, Defendant 1.
It should also be emphasized that in all his statements to the informant, Muhammad spoke about the murder of the deceased, and I do not mention once another possibility of harming the deceased that is not for the purpose of murder, and it is reasonable to assume that defendant 1 also heard the aforesaid things from Mohammed.
Arriving at the Lod gas station to create an alibi
Defendant 1, in his first interrogation with the police on July 2, 2019 at 2:32 P.M. (P/1), when asked where he had been about two weeks earlier, on June 17, 2019 at 8:30 P.M., replied: "In Lod ... In the Banit neighborhood I can take you to the gas station where I buy cigarettes,... And when I don't have cigarettes, I jump up and buy cigarettes and come back again because it's late and everyone is closed, and only the gas station is open and it's 3 meters away" (Q. 212-216).
All of Defendant 1's actions after the murder, as detailed in the reference to Muhammad regarding his presence at the Yoseftal gas station in the city of Lod, including his police versions in the initial interrogations, present an attempt by Defendant 1 to create an alibi for the murder.
Arriving at the gas station about an hour after the murder, the memory of that incident about two weeks later during his interrogation, and the mention of the incident in an attempt to present a claim of "alibi – I was somewhere else" will strengthen the evidence against defendant 1 for committing the murder.
