An examination of Muhammad's words to the informant reveals that in his words to the informant, Muhammad stated, among other things, the following:
"Detainee No. 1, known as "Bilal Rayan", is married to a beautiful woman? What is his wife's name?
Detainee No. 2, Muhammad Assiwi - he was married to Al Zaytuna, and he got divorced, now he's married to a slut, she's from Kafr Qasim, now my brother is a criminal, really a male criminal, he loves me, you see.
Stop No. 1, Bilal Rayyan - Ah-Ha
Detainee No. 2, Muhammad Assiwi - an unclear sentence (whispering) that will take the place of the other, you see." (P/20A, p. 3, s. 38).
In the aforementioned remarks, Muhammad talks about Defendant 2, who is the brother of a "man" criminal who died for him, and later Muhammad says an unclear sentence, after which he states "Let him take the place of the other."
From the aforesaid, it can be understood with a level of certainty, which is not high, that Muhammad states that his intention is that Defendant 2 will take his brother's place in the drug business shared by him and the deceased brother, as claimed by Defendant 2, a fact that is relevant to the proof of the "drug version" claimed by him.
Preference of the version before the informant over the version before the court
In their summary, counsel for defendants 2 and 3 argued that extra weight should be given to the testimony given by Muhammad in court over his version submitted to the court by means of section 10A of the Evidence Ordinance.
Moreover, counsel for defendants 2 and 3 themselves noted that Muhammad's testimony in court, even if it was accompanied by flaws, was given by him when the fear of his conviction in his own trial was removed, and this is his true version, and there is no dispute that when Muhammad testified in his case it was after he had finished testifying in his case, and he allegedly had the "key" in his hand that could shed light on the events in question, and therefore it appears that according to the defense's approach, at the end of the day, Muhammad gave his true version in court.
