On the merits of the matter, the prosecution claims that defendant 1, together with Yehoshua Shlosh, was behind the establishment of the straw companies JCC and ICT, and that he was the one who transferred to Yehoshua Shlosh the details of Meir Ben Shimon and his ex-wife Lucien Sadeh, with the intention that they would be used to register the aforementioned companies, for both of them.
I have already determined that the details of Meir Ben Shimon and Lucien Sadeh were received by Defendant 1 from Defendant 3, and I reject Defendant 1's denial and his claim that he did not even hear the name of Meir Ben Shimon. It should be noted that the name Meir Ben Shimon and his address appeared in the diary of defendant 1 (P/363), on one of the pages of June 2000. The address, 42 Remez St., Nahariya, appears in the founding documents of the ICT and JCC companies (P/227).
Yehoshua Shlosh was summoned to testify on behalf of Defendant 1, and stated that Natan Harpaz initiated the establishment of the two aforementioned companies, and that Defendant 1 was not involved in their establishment at all. This version can easily be rejected, since there is no logic in the claim that CPA Harpaz was the one who established the companies, and it was not clarified what he had to do with them. This puzzling version was not presented to Natan Harpaz during his testimony in court, and I reject it completely. I will add that no evidence was presented that CPA Harpaz had a personal interest in the establishment of the companies, JCC and ICT.
I also reject the argument of Shlosh, according to which defendant 1 had no connection to the establishment of the companies, and that they were not under his control. In this context, the prosecution presented Yehoshua Shlosh's clear words in his recorded conversation with defendant 3. In this conversation, Yehoshua Shlosh referred to the appointment of a manager for the two companies, referring to Ms. Ella Fishman, while linking defendant 1 to this matter:
