Judgment
- Prior to requests to certify and annul an arbitrator's award, remove the arbitrator from his position and alternatively appoint a substitute arbitrator.
For reasons of convenience, those requesting approval of the arbitral award will be referred to: "the applicants" and the applicant for the cancellation of the arbitral award will be referred to as "the respondent").
Introduction:
- On May 14,2025, an engagement agreement was signed between the Applicants and the Respondent (the owner of the 'I Have an Idea' company, which is engaged in organizing vacationers for the ultra-Orthodox sector), for the reservation of hotel rooms owned by the Applicants for the month of August 2025.
According to the respondent, already about two weeks before the date of the accommodation, he requested to cancel the agreement, after he learned that the engagements of other entities with the hotel had been terminated due to a poor level of service. Indeed, already in the first vacation cycle, significant deficiencies in the hotel's services were exposed. These included, inter alia: failures in the air conditioning system in public areas, poor food levels, murky pool water, and long waits to receive rooms that were found to be unclean. Against the background of these disputes, the Applicants sent the Respondent an arbitration agreement, the terms of which were imposed by the Applicants, and requested that an arbitration proceeding be held.
- There are now a number of interlocking proceedings before the court:
Civil Case 29125-09-25, Application for Approval of an Arbitral Award (amended application filed on October 26,2025), filed by the Applicants.
Civil Case 12916-11-25, opened on November 4,2025, a motion to set aside a judgment and alternatively motions to remove the arbitrator from his position and appoint a substitute arbitrator.
Objection to the execution of a deed No. 82698-12-25 - Objection to the execution of a deed in the sum of ILS 737,781 which was filed by the respondent. This deed is intrinsically connected to the financial dispute that is the subject of the agreement, and according to the respondent, it was given to the applicants by the arbitrators in the framework of an improper proceeding.
