Moreover, as far as terrorist organizations are concerned, the difficulty in combating them also stems from typical characteristics of those organizations, such as: a branched and decentralized structure, internal hierarchy and division of roles among members, spread over large geographical areas, as well as receiving material and moral support from elements in the public that support their activities [...] in order to deal with this serious and complex crime phenomenon, It is proposed to provide the law authorities with a variety of tools in the field of criminal and public law, the purpose of which is to prevent the existence and activity of terrorist organizations, to prevent and thwart terrorist activity, to damage the organizational and financial infrastructure that feeds it, and of course – to apprehend and prosecute criminals, all taking into account the special characteristics of terrorist activity."
As for the definition of "member of a terrorist organization" and the way to prove membership in a terrorist organization, it was noted :
"It is proposed to determine that a member of a terrorist organization is someone who is a member of the terrorist organization. Naturally, it is not possible to learn about membership in a terrorist organization according to formal procedures or documents, as is customary in "civilian" organizations. Accordingly, it is proposed that the test for proving a person's membership in a terrorist organization be based on circumstantial evidence that shows that he is affiliated with the terrorist organization and considers himself a member of it. "
The legislature's recognition of the difficulty of combating terrorist organizations and tracing membership in a terrorist organization, especially in view of the characteristics of these organizations in the form of a branched and decentralized structure; internal hierarchy and division of roles among members and spread over large geographical areas, etc., is evident and clear in the explanatory notes and constitutes the basis for the expansion of the definition of "a member."
