Returning to the issue of entitlement to the second half of the commission – additional support for the agreement regarding this payment can be found in the correspondence dated July 27, 2019 between Peleg and Don (Appendix 32 to Peleg's affidavit), in which Peleg wrote to Don that there was an agreement to divide the payment into 10/12 months and not 18 months, and that the agreement was to start making payments in June/July and not August, and in addition to that, in light of Don's request as to how the payment would be made, the amount would be 10% higher. To this, Don replied that he knew, but because the amount for each payment was too high, he had to stay in 18 installments, he had to start in August. Don also adds that he is not willing to pay an additional 10% and is willing to divide the payments into two (50/50).
Subsequently, on September 8, 2019, Peleg and Don correspond on WhatsApp, and Don writes to Peleg to issue an invoice, so that he can be paid. To this, Peleg replies that he will issue a transaction account and after payment he will issue an invoice, and Don on the other hand writes to Peleg that according to his account, each payment should be 121,250, Peleg on the other hand says that the agreement is 250,000 and later Don replies, "So 125? Spend it to Splitite Ltd. in shekels" and when Don is asked by Peleg what should be written on the account of the transaction and the invoice, Don replies: "Advice for an IPO, payment 1 out of 2."
On September 8, 2019, Peleg adds and writes to Gil (in a statement that was attached as Appendix 33 to Peleg's affidavit):
"Following our last conversation and in accordance with your request in the conversation... I am attaching the contract we signed that shows the agreements and gives you in this email confirmation to pay the second part of the payment for the initial funding (the funding was made in January) in two parts, the first part of which is by 15/9/2019 and the second part by 10/11/2019. The calculation of the payment amount should be done in accordance with the amount raised less than what has already been paid (as stated in the contract between us), this agreement does not require the creation of a new contract when the original contract is valid and I allow you to pay on the dates written above.
