The aforesaid statements will attest to a close friendship between Muhammad and Defendant 1, and they will certainly be able to present, as stated, things that can create a strong commitment on the part of Defendant 1 towards Muhammad, after he actually saved him from addiction to the drug "Nice Guy", and Muhammad's feeling that there is absolute loyalty in Defendant 1 and that he trusts him completely that his loyalty will not allow him to spy on him.
All of the aforesaid can serve as evidence of the motive that defendant 1 had to participate together with Muhammad in the murder of the deceased.
Leaving your mobile device in the city of Lod
A perusal of the communications outputs presented shows that telephone number 052-4094773 (hereinafter: "Telephone 422"), which was in the possession of Defendant 1 (see above at the time of the hearing in the Muhammad case) was located from 16 June 2019 at 22:29 until 17 June 2019 at 21:28, in the area of "Yoseftal 3 Lod" and as of 21:44 it was located elsewhere.
From the aforesaid facts and the facts detailed above regarding Muhammad's phone, it appears that the phones of Muhammad and Defendant 1 were both in the area of "Yoseftal 2,3 Lod" from the evening before the murder until about an hour after the murder (which, according to the indictment, took place on 17 June 2019 at approximately 8:26 P.M.), and this fact would testify to the attempt of Defendant 1 and Muhammad to conceal their location during that period of time.
During the interrogation of defendant 1 in court, the defendant was referred to the fact that on his trip with defendant 2 and Muhammad to the Occupied Territories three days before the murder, he drove without a phone, and in his reply: "I forgot my phone... at home," and later when he was asked, "And the second time you went to Hura, did you also forget the phone?" he replied: "It's normal that I forget the phone" (transcript of December 26, 2022, p. 293, s. 22 to p. 294, s. 7).
These words of the defendant will strengthen the feeling that the permission to leave the phone from Lod was not done by chance.
