A liquidation order given in Australia or in another jurisdiction for a company of such jurisdiction will be recognized in Israel

The liquidators of a number of Australian companies sought to recognize in Israel liquidation orders of Australian companies, which were given by the Australian competent Courts in a liquidation procedure initiated by the Australian Tax Authority, so that they could take actions in Israel.
The Court held that in light of the entry into force of the Israeli 2018 Insolvency and Economic Reconstruction Law, Australian liquidation orders may now be recognized in Israel. The new insolvency law provides that a foreign liquidation procedure may be recognized in Israel, provided that the applicant for recognition is the officer appointed in the foreign procedure. Foreign tax enforcement procedures cannot be enforced in Israel when the foreign tax authority, as such, seeks to initiate a collection process in Israel. However, if the tax collection is carried out indirectly, through liquidators authorized under a foreign procedure relating to insolvency, then the liquidation procedure will be enforced in Israel.
