A manager in a corporation illegally employing foreign workers may be personally liable

A company employed foreign workers in violation of the law.

The Court held that the company is guilty of employing foreign workers without a permit but acquitted the company manager. A manager of a company must act in every possible way to prevent offenses by the company or its employees, including providing adequate instructions in checking work visas when an employee is hired, ensureing review of visas and their validity and issuing appropriate guidelines to the employees as to the law. Here, the manager did everything in his power to prevent the illegal employment, gave sufficient instructions both in as to checking the employee's visa at the time of hiring and in providing sufficient instructions in reviewing visas on a regular basis. Thus, the manager is not personally responsible for the employing of foreign workers without a permit.
