Notarial Affidavit

Print

A notarial affidavit is an affidavit signed before a notary public affirming that the affiant knows the language of the statement and reads it in the presence of the notary, has been duly warned that he undertakes to declare the whole truth and the truth only, and that if he fails to do so will be liable to the penalties prescribed by law. Alternatively, the affiant may sign the affidavit before the notary public after the notary or a translator has translated the statement and after being duly warned. The notary public in any case must know the language in which the statement was written.
The signature before a notary public means that the validity of the document is almost impossible to attack and is especially important when it comes to older people with whom somebody may in the future question their competence to sign the statement. In such a case, validating the statement by a notary public may save a lot of time and resources in the future by avoiding legal disputes.
