Publication in the Hamodia newspaper on the High Court of Justice appeal in the case of Afik v. Israeli Auditors’ Council

Doron Afik, Esq. and Yair Aloni, Adv. of Afik & Co. recently petitioned the Israeli High Court of Justice against the Israeli Auditors' Council, Minister of Justice and the Institute of Certified Public Accountants in Israel. The petition, filed on behalf of attorney Doron Afik and 424 N.T.Salt Ltd., manufacturer, distributor and exporter of Dead Sea gourmet salt products, argues that the Rules of Conduct of CPA’s and the regulation which limits one’s ability to hire an accounting services without getting the consent of the previous auditor are illegal and therefore void. The requirement of a consent from the previous auditors is unlawful, disproportionate or unreasonable and violates many fundamental constitutional rights such as the freedom of occupation, of the new auditor and the client, as it prevents the client to act in the ordinary course of business. Also, such limitation also violates the autonomy of the client and its right to act on its free will and choose an accountant to represent it as it freely wishes. The High Court of Justice set the case for a hearing February, 2017.
