A European local authority is subject to the proportionality principle when demanding data and documents for licensing

In the process of licensing of the trucks manufacturers association in Spain as a representative of the manufacturers the city of Barcelona demanded an immense amount of data and documents and specificity of commercial data.

The Court of Justice of the EU ruled that there is a need to limit the amount of documentation submitted in cases of licensing by local authorities in the EU. The Principle of Proportionality stipulates that under EU law there is no need to burden the regulatory framework or raise the bar of the framework, unless there is a case of fundamental rights or legitimate interests breach. In these cases, the authorities need withstand the current regulatory level, both in quality and quantity, and not burden the parties in repeating requests for further documentation. Cases as such will be deemed misuse of EU law.
