Even using three seconds only of a well-known music track may constitute a copyright infringement

An advertising company launched a marketing campaign on television and on the Internet in which it used, among other things, three seconds of well-known musical track without obtaining a permit and without payment for the copyright of the music.

The Court accepted the claim and ordered the company to compensate the creator due to copyright infringement. A copyright gives the holder the exclusive right to use the creation. This right can be transferred or sold, by contract or license. Here, permission to use was not obtained from the copyright holder and the commercial use of the work did not stop. Therefore, the infringers were required to compensate the copyright owners in the amount of 2.5 times the original amount they would have paid for the use if they had applied for a license as required.
