The hours of work and rest law will apply to intermediate level or junior ‎managers

A dismissed employee claimed that he is entitled to overtime pay. The employer argued that the hours of work and rest law does not apply as the employee was a manager.

The Labor Court held that intermediate or junior management level employees are subject to the law and that the law exceptions are to be narrowly interpreted. In this case, it was not proven that the employee had the authority to set policy, was at a high management position or was a secret bearer for the high management, or was paid high salaries. Thus, the hours of work and rest law applies on the employee and he is entitled for payment of overtime.
