Unfair influence on a testator negates free will and may lead to invalidation of a will

A son opposed the probate of his late mother's will due to her cognitive incompetence as well as unfair influence at the time it was executed.

The Court accepted the objection due to doubts as to whether the deceased was of clear mind at the time the will was drawn up. Israeli law states that a will is to be signed on one’s own free will and that when a notarized will is drawn up for a sick and nursed person, a medical certificate of the same date must be attached confirming that the testator is cognitively competent. Here, the testator was a 100 years old elderly nursed woman who spoke Russian only with a medical certificate existing by not one given at the same day, but five days prior the signing of the will. Also, there were complaints of violence of the beneficiary against testator. Therefore, the will was invalidated and the previous will was probated.
