One cannot dismiss an employee due to downsizing but at the same time ‎hire a new and more expensive employee

An employee’s employment was first limited and that the employee was dismissed, all due to downsizing but at the same time the employer hired a more expensive employee.

The Court held that flaws existed in the dismissal process, both with regard to the unilateral reduction of the scope of the position and with regard to the dismissal and hiring of another employee that received a salary which is almost triple that of the dismissed employee, all despite the fact that the background for the dismissal was claimed to be downsizing of the employer. Thus, it was held that the employee is entitled to compensation both for the dismissal and the unduly made hearing prior to the dismissal.
