A parallel importer distributed in Israel products bearing the name and details of the official importer that were printed on the packaging by the manufacturer (together with names of several official importers worldwide and alongside a sticker with details of the parallel importer).  The official importer argued that this is a tort of passing off and misleading customers to believe that it is products imported by it.

The Court held that a purchaser of merchandize purchases also the reputation attached to it.  When the official importer, by act or default, agreed to have its name printed on the packaging manufactured by the manufacturer, the name and details become part of the marking of the product and thus, if the product is legally purchase, the parallel importer has the right to use such markings.
