A Facebook group operator who lingered to remove defamatory publication may be responsible for the publication

It was posted on a Facebook group that a man was caught stealing and was therefore dismissed from his job. Later, the victim of the publication filed a claim against the group operator contending that although the operator did not publish the publication itself, he took his time to remove the publication and a few hours later published a new post, along with a picture of the defaming publication, while increasing its resonance, for the alleged discussion on the dilemma he was facing.

The Court ordered the group operator to pay compensation and held that the Facebook group is an open one and the group operator has no control over the publications therein and cannot prevent publication in advance or be held responsible for the initial publication. As to republication, the group's operator has a good faith defense regarding publications that are broadcasted on radio or television and was not recorded in advance. Although the defense under law does not apply to advertising on the Internet, it must be interpreted according to the spirit of the time and technological progress. However, in view of the inexplicable delay in removing the publication, the group operator bears responsibility for the first publication and direct responsibility for the second publication.
